1. About this policy
Gateway Finance Pty Ltd (ABN 43 608 990 834, ACN 608 990 834), Australian Credit Licence 518395, is committed to protecting your privacy. In this policy, "we", "us" and "our" mean Gateway Finance Pty Ltd.
This policy explains how we collect, hold, use and disclose your personal information, and how you can access it, correct it, or make a complaint. It applies to our website, our offices, and every interaction you have with us.
This policy also applies to Gateway Asset Finance, a trading name of Gateway Finance Pty Ltd (ABN 43 608 990 834).
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because we arrange credit, we are also bound by Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code, which govern credit-related information.
2. What personal information we collect
The information we collect depends on how you deal with us.
If you contact us through our website, phone or email, we generally collect only your name, email address, phone number, and whatever you choose to tell us about your enquiry.
If you ask us to help you obtain or manage credit, we need considerably more, because lenders require it to assess an application. This may include:
- Your name, date of birth, contact details and residential address history
- Identification documents, such as a driver licence or passport
- Your employment details and income
- Your living expenses, assets, liabilities and financial commitments
- Bank statements and other financial records
- Details of the property, vehicle or asset being financed
- Your relationship status and number of dependants
- Details of your objectives, requirements and financial situation, which we are required to record
- Credit information, including credit reports and repayment history - see section 7
We may also collect information about you from third parties, such as your accountant, your broker referrer, or a person who refers you to us - see section 3.
3. How we collect personal information
We collect personal information:
- Directly from you, in person, by phone, by email, through our website forms, or through documents you provide
- Through our social media pages and advertising, including lead enquiry forms
- From credit reporting bodies, lenders and other credit providers
- From your representatives, such as your accountant, financial adviser or conveyancer
- From publicly available sources
- From referral partners, where someone has referred you to us
- From Connective, our aggregator, which provides the systems we use to manage and lodge loan applications
4. Why we collect, hold, use and disclose it
We collect and use your personal information to:
- Respond to your enquiry
- Assess your objectives, requirements and financial situation so we can provide credit assistance
- Compare credit options across our lender panel and make a suitable recommendation
- Prepare and submit applications to lenders on your behalf
- Comply with our obligations as a credit licensee, including the best interests duty under the National Consumer Credit Protection Act 2009
- Verify your identity and meet our obligations under anti-money laundering and counter-terrorism financing law
- Manage our relationship with you, including reviews after settlement
- Respond to complaints and disputes
- Meet our record-keeping, audit and legal obligations
- Send you information about our services, where you have not opted out - see section 8
If you do not provide the information we ask for, we may not be able to help you obtain credit, and lenders may decline to assess an application.
5. Who we disclose it to
We may disclose your personal information to:
- Lenders and credit providers on our panel, when arranging or applying for credit on your behalf
- Credit reporting bodies, and other credit providers - see section 7
- Mortgage insurers, valuers and settlement agents involved in your transaction
- Your representatives, such as your accountant, solicitor or conveyancer, where you have authorised it
- Connective, our aggregator, which provides our loan lodgement and customer relationship management systems (including Mercury CRM)
- Our service providers, including IT, customer relationship management, document storage, marketing and administrative suppliers
- Regulators and external dispute resolution bodies, including ASIC, AFCA and the OAIC, where required
- Anyone else you authorise, or where disclosure is required or permitted by law
We do not sell your personal information.
6. How we hold and protect your information
We hold personal information in electronic systems and take reasonable steps to protect it from misuse, interference, loss, unauthorised access, modification and disclosure. These steps include access controls, staff training and secure storage.
We retain personal information for as long as it is needed for the purposes described in this policy, or for as long as the law requires. We generally keep client records for 7 years. When information is no longer required, we take reasonable steps to destroy it or de-identify it.
7. Credit information and credit reporting
Because we arrange credit, we handle credit information and credit eligibility information as those terms are defined in the Privacy Act. This is subject to Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code, in addition to the Australian Privacy Principles.
- We may obtain a credit report about you from a credit reporting body, or receive credit eligibility information from a lender, in order to assess your application.
- We may disclose credit information about you to lenders, and to credit reporting bodies where permitted.
- We will not use or disclose credit eligibility information for direct marketing.
- The credit reporting body we deal with is Equifax. You can read its credit reporting policy at equifax.com.au.
- You have the right to request that a credit reporting body not use your credit information for pre-screening direct marketing, and to request a ban on the use of your credit information if you believe you have been or may be a victim of fraud.
8. Direct marketing
We may send you information about our services by email, SMS, phone or post, where the law permits.
You can opt out at any time by using the unsubscribe link in any message, or by contacting us using the details in section 13. We will action your request promptly and at no cost to you.
We do not use credit eligibility information for direct marketing.
9. Overseas disclosure
Some of our service providers, including cloud hosting, customer relationship management and marketing platforms, may store or process information outside Australia, including in the United States.
Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, unless an exception applies.
10. Automated decision-making
We use automated systems, including AI assistants, to help handle enquiries and respond to questions about our services. These systems may use your name and the contents of your enquiry to provide information and to route your enquiry to the right person.
Decisions about your credit application are not made by automated systems. Credit assistance is provided by a person, and every recommendation is reviewed by a qualified broker.
Where a lender uses automated decision-making in assessing an application, that lender's own privacy policy will describe it.
11. Accessing and correcting your information
You can ask us for a copy of the personal information we hold about you, and you can ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
Contact us using the details in section 13. There is no charge for requesting access. We will usually respond within 30 days. We may need to verify your identity before we can act on your request.
If we refuse a request, we will tell you why in writing and explain how you can complain.
12. Complaints
If you believe we have breached the Australian Privacy Principles, the Privacy (Credit Reporting) Code, or mishandled your personal information, please tell us first.
Step 1 - Contact us. Use the details in section 13. We will acknowledge your complaint and investigate it. We will usually respond within 30 days.
Step 2 - External dispute resolution. If you are not satisfied with our response, you can contact the Australian Financial Complaints Authority, our external dispute resolution scheme:
